PRICES: all our prices are inclusive of VAT as of July 1st 2010. Food: 8% VAT, non food & cooking tools: 18% Standard VAT.

Law, regulations and authorities governing the services and products marketed by Iberic Delice and the webshop www.ibericdelice.com (hereby named Iberic Delice) are the spanish and standard EU laws and regulations.
This document GTCSPU summarises the important informations, procedures and rules that you need to consider carefully prior to ordering our products and services.

Acces to Iberic Delice's services and creation of a user account is exclusively granted to adults, legally responsible persons.

Wines and Licor sales are not authorised to minors under legal age. By creating a user account you commit to enter accurate and faithfull information, for which you are responsible.
The abuse of alcohol is dangerous, and moderated and responsible comsumption is recommended.

Online orders at www.ibericdelice.com:

ONLINE ORDERS: WE GEOGRAPHICALLY SHIP TO COUNTRIES LOCATED IN THE EUROPEAN UNION AND OUT OF THE EU AND EEC. Shipping costs quotations online are available only for european countries, and not for over seas territories, DOM TOM, Commonwealth, Duch Guyana, etc. For shipping to these areas please ask us a special quotation by email and proceed offline.

The informations, product descriptions, prices and other terms are subject to eventual modifications and they will be taken into account for new incoming online orders of the day.

All online orders are accepted and processed only after notification of acknowledgement or of a Sales Order by email from Iberic Delice.

For other order processes and for other products or services not advertised online, the order processing and related communications will be ensured by direct communication between the customer and Iberic Delice, by email, telephone and fax.

Any daily modification that may affect an order of the day will be communicated to the customer prior to confirming and processing his order, the customer will have then to confirm his aceptance of the new conditions or to cancel the order. Eventual retainer on credit card and prepayments will be refunded upon reception of order cancelation notice.

We support the following languages: French, English, Spanish.

Volume orders: are processed offline directly with Iberic Delice by phone, fax or email

Volume orders are Purchase Orders (PO) defined by quantity, amount in Euros or several units of the same item, and/or POs from businesses with special conditions (volume POs, regular orders).
Maximum amount accepted online:
We accept and process online orders up to 650 Euros (six hundred and fifty Euros).

We do not process online orders of more than 650 Euros (six hundred and fifty Euros) at www.ibericdelice.com. In such a case for orders of more than 650 Euros we invite you to contact us directly by phone and email in order to get a special quotation with better commercial conditions for you, and we inform you of the terms that apply.
Maximum units per unique product:

Are also considered Volume Orders those orders requesting more than 5 units of the same item, slices and small products like chorizos, other than hams, and in any cases whose total amount are as followss: either more than 5 units same item, or more than 4Kg not ham items, or 2 whole hams or more than 2 whole hams (> 5 units, or > 4Kg not hams, or >= 2 hams or more).

Orders from Businesses and Professionals

Orders from Businesses and Professionals (shops, restaurants, hotels, corporates) are welcome.

You can order online, in such scenario our standard GTCSPU apply. You can also contact us directly for volume orders.

Special conditions on volume orders are available and will be communicated on a case by case basis. Commercial terms and authorisation of return of merchandise are not the same than standard GTCSPU (payment by bank transfer for volume orders, prior testing and knowledge of the Iberic Delice items ordered in volume, RMAs on proven defective items and erroneous shipment only).

3. CUSTOMER SERVICE

We communicate with customers and inform them by standard remote tools: electronic communications (website, email, webforms) and telephone and fax, all communications tools and contact details are published at www.ibericdelice.com and the Contact section.

Support is currently available in the following languages: French, English, Spanish.

German Customers: we do not currently support German language.
German Visitors and Clients using the German version: we currently do not communicate in German, however, as much as possible product information and some general details and specifications are/will be available in German.

4. SHIPPING CONDITIONS, SHIPMENT METHOD, LEAD TIME

We currently ship to European Union customers (West, Central, South, Nordic) AND WorldWide out of the EU. with some country restrictions, should you have a doubt please consult us directly. ONLINE ORDERS: WE GEOGRAPHICALLY SHIP TO COUNTRIES LOCATED IN THE EUROPEAN UNION EU AND OUT OF EUROPE. Shipping costs quotations online are available only for european countries, and not for over seas territories, DOM TOM, Commonwealth, Duch Guyana, etc. For shipping to these areas please ask us a special quotation by email and proceed offline.
We process online orders for shipping NON FOOD, NON ALCOHOLIC products out of the EU.

ALCOHOLIC products shipping to EU: special taxes on destinations are your responsability. Some restrictions by some countries, consult us.

Customers outside European Union: please consult us directly at +34 661 77 50 28 or email infor-AT-ibericdelice.com. Some countries have strict health or customs regulations that may prevent a delivery. Some products available from our providers have US FDA approval, please consult us.

Shipping out of the EEC European Economic Community (North America, Asia, Non EC Europe):

Incoterm DDU applies by default.
Customs clearance and fiscal obligations, VAT and any taxes on destination required by local authorities are the customer's responsability.
Some countries require health and or specif certificates for food and wine, alcohol, please consult us. By default we ship only non food products out of EC, with some exceptions (canned food, sweets). USA: no food shipped unless we offer you FDA approved products. To be approved and managed offline.

We ship to the European Union by Spanish Correos or UPS services as per Iberic Delice's decision.

We ship in Spain by normal Correos service (Spanish PTT, with certified delivery) and by UPS according to customers' request.

Lead Time: Lead Time is the time between an order is aknowledged by Iberic Delice and the actual shipment out from Iberic Delice's facilities:
- Normal lead time is 48h00.
- Any order acknowledged a working day before 6 p.m. is under normal conditions shipped within 48h00 or less (in any cases before a maximum of 4 working days).
- Any order aknowledged after 6 p.m. or received during the week-end is shipped withing 3 working days, 4 maximum.
Logistic partners transit times are added, Correos. As an example, a delivery to Western Europe, to principal Cities, should occur in normal conditions in a maximum of 5 working days.

Important Considerations 1: exceptionnal conditions may affect transit times (stormy wheather, snow, strikes and demonstrations stopping traffic on roads, air traffic control problems or strikes). In those -force majeure- scenarios Iberic Delice shall not be held responsible of the eventual resulting excessive lead and transit times and the delaying of deliveries.

Important Considerations 2: during european national and bank holidays, during local spanish holidays and month of august lead times and transportation times may be impacted, in such a case please consult us. Some information shall be also available at www.ibericdelice.com.

Goods are delivered under a packaging ensuring sufficient thermal isolation in order to keep their organoleptic properties intact when you receive them. Goods stocked longer in our warehouse are kept in cold chamber (slices), under controlled temperature and atmosphere (whole hams), and are packaged a few hours only prior to collection from our logistics partners.

5. PRICES

All prices are in Euros, Inclusive of VAT, exclusive of shipping costs (excepted other specific mention, when indicated for special offers and promotions like -VAT inclusive, inclusive of shipping cost- etc).

You will be informed of the total price of your order at the end of the online ordering process, once shipping and payment method are selected, prior to final payment confirmation.

Shipping costs: you can always consult them by filling a Purchase Order, with no commitment if you do not proceed with the payment process. Costs are Subject to changes.

Calculation: flat rates per weight brackets. This means you are not paying x times the shipping cost of 1 single item, but an overall final weight cost. Example (fictive): 1 sliced ham 100g shipping cost is 17 euros to Iceland, 3 sliced 300g hams still ship at 17 euros cost exc VAT.

Weight: the weight of an item is different from the weight of the packaged item. Same VAT applies to the item and to the shipping.

6. PAYMENTS, PAYMENT METHODS, SECURE PAYMENTS

Payment methods accepted by Iberic Delice are:
- bank transfer to Merchant Account of Mr R. F. SANTANA, Managing Director, Iberic Delice,
- credit card (VISA, MASTER.C., etc): secure payment at a secure interface hosted by La Caixa (3rd largest spanish financial institution),

CREDIT CARD OR MONEY TRANSFER SWIFTS.
- UNDER NO CIRCUMSTANCES IBERIC DELICE SHALL BE LIABLE OF FINANCIAL COSTS AND COMMISSIONS RESULTING FROM A PAYMENT OF AN ORDER.
INTERNATIONAL TRANSFERS / SWIFTS:
IMPORTANT NOTICE:
- ENSURE COSTS OF THE TRANSACTION ARE CHARGED EXCLUSIVELY IN ORIGIN, IE TO SENDER, THE CUSTOMER PLACING AN ORDER.
UNDER NO CIRCUMSTANCES IBERIC DELICE SHALL BE LIABLE OF FINANCIAL COSTS RESULTING FROM A PAYMENT.
- INCOMPLETE PARTIAL PAYMENT:
WE DO NOT SERVE AND SHIP ANY ORDER THAT IS NOT FULLY PAID. ALTERNATIVES ARE TO SHIP LESS PRODUCT THAN ORDERED, TO WAIT UNTIL AN ADDITIONNAL PAYMENT IS RECEIVED, OR TO REIMBURSE, UPON IBERIC DELICE'S DECISION ON A CASE BY CASE BASIS AND SCENARIO. THE CUSTOMER WILL BE INFORMED PRIOR TO PROCEEDING.
ALL COSTS AND COMMISSIONS FROM BANKS RESULTING FROM REIMBURSEMENT WILL BE DEDUCED FROM THE MONEY RECEIVED, THUS THE CREDIT BACK TO CUSTOMER MAY BE INFERIOR TO THE AMOUNT RECEIVED.

- SWIFT - BIC - IBAN - ACCOUNT HOLDER: PLEASE ENSURE CAREFULLY THAT YOU COPY AND PASTE EXACTLY OUR IBAN AND ACCOUNT HOLDER AS DESCRIBED IN OUR ONLINE PAYMENT INTERFACE, OR BY DIRECT EMAIL TO YOU.
- PARTICULARLY ACCOUNT HOLDER IS: R. F. SANTANA (Iberic Delice)
- WRONG TRANSFERS:
BANKS MAY CHARGE US AUTOMATICALLY FOR AN ERROR IN THE IBAN OR ACCOUNT HOLDER DURING A MONEY TRANSFER. IN SUCH A CASE WE WILL DEDUCE THE COMMISSIONS CHARGED BY BANKS. AS OF 03-2010 BANKS ARE CHARGING A MINIMUM 15 EUROS FEE AND 1% ON THE AMOUNT HANDLED. THESE FINANCIAL CHARGES AND COSTS WILL BE CHARGED TO THE CUSTOMER PLACING AN ERRONEUS SWIFT INTERNATIONAL TRANSFER, WHO HAS NOT USED CORRECTLY OUR BANK DETAILS.
THESE FEES AND COSTS ARE SUBJECT TO CHANGES FROM BANK TARIFS POLICIES.
- REIMBURSEMENTS:
REIMBURSEMENTS DUE TO CAUSES OUT OF OUR RESPONSABILITY (RETURNING GOODS WITH NO JUSTIFICATION OR BECAUSE OF A CUSTOMER PLACING AN ERRONEUS ORDER): OUR BANK CHARGES FEES FOR INTERNATIONAL AND LOCAL MONEY TRANSFERS.
FOR INDICATION ONLY, AS OF 03-2010 FEES ARE 3 EUROS FOR TRANSFERS IN SPAIN, AND 12 EUROS FOR INTERNATIONAL TRANSFERS. PRICES MAY BE SUBJECT TO CHANGES BY BANKS.
- DIRECT REIMBURSEMENT VIA THE CREDIT CARD ONLINE INTERFACE (VIRTUAL POS) IS ALSO SUBMITTED TO COMMISSIONS BY BANKS, FOR INFORMATION BY 2009 THESE REIMBURSEMENTS WERE SUBMITTED TO A 2% COMMISSION ON THE AMOUNT TRANSFERED. SHOULD THE REIMBURSEMENT NOT BE CAUSED BY IBERIC DELICE DEFAULT OR MISFUNCTIONNING, IT WOULD BE DEDUCED FROM MONEY RECEIVED FROM THE CUSTOMER.

7. RETURNING MERCHANDISE, RMA

We are not accepting items and goods shipped back after seven days upon delivery.

You are authorised to return the goods that you have ordered in their original packaging with no justification within maximum seven days upon delivery, and with prior authorisation from Iberic Delice and the communication of an RMA number.

It is compulsory to contact us in order to get an RMA number, prior to shipping back the goods, and we reserve the right to refuse any shipment not authorised.

NO RETURN WILL BE ACCEPTED WITHOUT A VISIBLE RMA NUMBER ON THE PARCEL. Shipping costs will be at customer's charge.

Volume Orders (either more than 5 units same item, or more than 4Kg not ham items, or 2 whole hams or more) and orders from businesses are submitted to special terms, and to special conditions for applying for an RMA and a returning authorisation. Please consult us directly at Tel +34 661 77 50 28 and infor-at-ibericdelice.com.

Important Consideration 3: it is important to note that the packaging of a whole ham for returning it under RMA must be appropiate. When communicationg an RMA number we will provide you with instructions for the correct preparation of the parcel. Particularly, do not cover the ham completely with plastic, basically it shall be able to breathe in the box, some air must be left in the box, and the ham coverered only by paper and cotton tissue. Otherwise, the ham's quality and taste may be severely affected, preventing its consumption and nullifying its comercial value.

Important Consideration 4: shipping adress for returning under RMA number may be different, some of our local agents may be involved for local handling and making the process more simple for customers.

Problems on arrival:
All our parcels are shipped with an integrity seal, sticked with strong adhesive on the parcel.
This seal ensures that nobody opens your parcel and during transit. It is important to note: should the parcel arrive dammaged, with a whole on it, please take a picture of it (like with your mobile phone) raise a complaint and if relevant, refuse the shipment, as it may likely had been open for stealing some content, or goods may have been broken or damaged. This is not a common case, but pay attention to the seal of integrity, if it is broken the parcel may have been open prior to arrive at your premisses. Only Customs and Police agents can open parcels for routine checks during transit, and they put a label with their identification on the parcel when they do so.

8. PRIVACY POLICY, SECURITY

- Iberic Delice complies with the spanish LOPD (Ley Orgánica de Protección de Datos) and with the standard EU regulations related to privacy of personnal data.
- Webforms with sensitive personnal data are secured by our ISP and webservices provider mediating SSL encryption. You can see when you navigate under an encripted secured environment when the url you are visiting starts by https (like https://www.ibericdelice.com/section), in such a case your web browser displays a lock. This is important to be checked when you proceed to payments, and provide sensitive personnal and financial information online.
- Iberic Delice's operations database is hosted by the datacenter of our hosting provider (1and1 currently), in their high security hosting center.
- Iberic Delice does not communicate in any circumstances your personnal data to third parties not directly related to our operations, particularly not to parties like marketing agencies, advertisers.
- Your personnal data, like Shipping Adress will be communicated to our logistics partners (PTT, Correos, UPS, etc) and when ordering with us, you confirm your acceptation to this communication.
- Your bank data will be handled by our financial partners PayPal and Spanish banks (La Caixa).

- In order to Optimize the site IbericDelice.com, some Traffic Analysis tools are installed at IbericDelice.com, that follow-up incoming traffic and browsing activity, not including nor related to any personal identification or any personal data. In particular Google tools are used (please consult google.com for further information on the usage that Google may perform on these collected data), and also other traffic control tools. In no circumstances we process or manage with these tools your personal data records, nor we forward them to the providers of traffic analysis services and tools.
- By entering into IbericDelice.com and using its services and contents, you are accepting this traffic analysis performed at IbericDelice.com.

Bank and Financial data

Iberic Delice does not keep record of financial data, and particularly of credit cards related information. The data kept in records are those required by tax authorities, particularly Invoicing Adress. Financial data or bank numbers eventually backed-up are partial records (cards and bank numbers incomplete) in order to prevent any abusive use. These data are not kept online by Iberic Delice's servers but only offline (paper records of orders and sales orders) for tax declarations purposes and book keepings.
Sensitive and complete financial data are recorded by our financial partners, Banks and PayPal, they work under highly secured online environments (corporate high performance firewalls, high performance encryption, anti intrusion systems, etc). These data may eventually be consulted by Iberic Delice to adress a complaint from a customer, or upon authorities request, or in case of an unvalid payment resulting in an unpaid invoice.

9. RESERVE, LIMITS TO CUSTOMERS ACCEPTANCE

We reserve the right not to enter in deals with some customers under specific conditions:

We are not accepting orders from customers showing a repeated clearly abusive and or delictive behaviour. These abusive behaviours may be related to the security of credit card and bank payments, to the use of delictive funding, to the (repeated) returning of goods with no justification, to customers with a clear difficulty to understand online information and processes at www.ibericdelice.com, and customers for whom some information has been disclosed to Iberic Delice by authorities, Police, or by our financial or logistics partners.

10. LINKS

Iberic Delice does not take any responsability on Contents and Services offered by sites of 3rd parties, that may crosslink with IbericDelice.com. Should you have to report us some un-normal activity or for any issue, feel free to contact us, in order that we consider removing the link, and if possible to us, that we may recommend you eventual corrective actions.

11. JURISDICTION

Iberic Delice is a business established, run and registered in Madrid, Spain. In case of a conflict of interest or of an unresolved complaint, resolution should be found at Madrid Courts, under Spanish Jurisdiction.
